1. Acceptance of Terms

By accessing or using ImageSticker.pro ("Service"), you agree to be bound by these Terms of Service ("Terms"). This is a legal agreement between you and Frejos LLC, an Arkansas-based Limited Liability Company. If you do not agree to these Terms, do not use the Service.

2. Service Description

ImageSticker.pro, operated by Frejos LLC, provides AI-powered image generation services ("Sticker Generation") using Google Gemini API technology. Users purchase credits to generate custom stickers in various art styles.

2.1 Credit System

2.2 AI Model Changes & Credit Tier Flexibility

IMPORTANT: AI Model Technology is Evolving

ImageSticker.pro uses Google Gemini API models to power sticker generation. The specific AI models used for each credit tier (Pro and Standard) are determined solely at our discretion and may change at any time without prior notice.

Model Assignment & Changes

  • We determine which Google Gemini AI models are used for Pro Credits and Standard Credits
  • Models may be changed, upgraded, or replaced with newer versions at any time
  • Changes may occur to improve quality, performance, cost efficiency, or feature availability
  • You are purchasing credits for a specific tier level, NOT access to a specific AI model

Model Sunset & Discontinuation

Google may sunset (discontinue) AI models at any time. This is beyond our control and subject to Google's product lifecycle decisions. In the event a model currently used for a credit tier is sunset by Google:

  • Option 1 - Model Replacement: We will replace the sunset model with a comparable or superior Google Gemini model for that credit tier
  • Option 2 - Credit Conversion: We may convert affected credits to another credit type (Pro ↔ Standard) at a fair exchange rate
  • Option 3 - Tier Discontinuation: We may discontinue selling credits for that tier if no suitable replacement model exists

Your Rights During Model Changes

No refunds will be issued for unused credits when models are changed, replaced, or discontinued. Your rights when this occurs are:

  • Continue using existing credits with the replacement model in that tier
  • Accept credit conversion to another tier (Pro ↔ Standard) at a fair exchange rate
  • Use your credits before any tier discontinuation takes effect

2.3 AI Generation Service Nature & Limitations

IMPORTANT: UNDERSTANDING WHAT YOU ARE PURCHASING

When you purchase credits, you are purchasing the right to generate an image using the AI model with specific instructions (your selected art style, emoji, settings, and custom prompt). You are NOT purchasing a specific image output or guaranteed result.

AI image generation is inherently variable and unpredictable. There is NO GUARANTEE that the generated image will:

  • Match your expectations or mental visualization
  • Be "correct" according to any objective standard
  • Accurately interpret your custom prompt
  • Produce the desired artistic style or quality
  • Be suitable for your intended use

The only guarantee is that the AI will produce a valid response image based on your inputs. The quality, accuracy, or suitability of that image is not warranted.

2.4 Credit Consumption is Immediate & Non-Refundable

AI image generation services are consumption-based. By generating an image (even one you consider "bad" or unsatisfactory), you are:

  • Consuming computational resources and API credits
  • Incurring real costs to us (Google Gemini API charges per generation)
  • Receiving the service you purchased (AI processing of your request)

Credits are consumed immediately upon generation, regardless of output quality. If you are dissatisfied with the result:

  • Modify your input image to better match the desired outcome
  • Adjust generation settings (art style, framing, intensity)
  • Refine your custom prompt with clearer instructions
  • Try again using additional credits (each attempt consumes 1 credit)

Sometimes AI models produce unexpected or undesirable output. This is the nature of AI technology and does not constitute a service failure or grounds for refund.

2.5 Customer Feedback & Support

We value our customers and your experience matters to us. While we cannot guarantee specific outputs or refund credits for unsatisfactory results, we genuinely want to improve our service.

If you believe something is truly wrong with the service (not just an undesired result) or have suggestions for improvement, please contact us at support@imagesticker.pro. We review all feedback and use it to enhance our prompt engineering, model selection, and user experience.

2.6 Generated Image Storage & User Responsibility

CRITICAL: WE DO NOT STORE GENERATED STICKERS.

Generated sticker images exist only in your browser's memory during your active session. We do NOT save, store, or retain any generated images on our servers or in any database.

YOU ARE SOLELY RESPONSIBLE for downloading and saving any stickers you wish to keep. You MUST use the download mechanism provided immediately after generation. Once you close the browser tab, reload the page, or navigate away, all generated images are permanently lost and cannot be recovered.

LOST IMAGES CANNOT BE REGENERATED: Due to the nature of AI image generation, each generation request produces a unique result. If you lose an image (through browser closure, crash, or failure to download), we cannot recreate the exact same image. The AI will generate a different result each time, even with identical inputs. You may only use additional credits to generate new images, which will differ from the original.

By using this Service, you acknowledge and accept that:

  • Generated stickers are displayed in your browser only (client-side storage)
  • No server-side backup or storage of generated images exists
  • Lost images cannot be regenerated or recreated in any case
  • AI generation produces unique results each time - exact reproduction is impossible
  • Generating new images requires consuming additional credits
  • We are NOT responsible for any lost images due to browser closure, crashes, or user error
  • Image storage beyond initial generation and display is YOUR responsibility

⚠️ TELEGRAM STICKER PACKS ARE DIFFERENT:

While we don't store generated images on our servers, uploading to a Telegram sticker pack DOES store the 512×512 PNG version on Telegram's servers permanently. This is separate from downloading to your device.

You must still download all formats (Original, Discord, etc) to your device before leaving the page, or they'll be lost. Only the 512×512 PNG format is uploaded to Telegram; all other formats remain in your browser only, unless downloaded by you.

2.7 Telegram Bot Integration Services

We offer an optional feature to create and manage Telegram sticker packs via our Telegram bot @ImageStickerProBot. By using this feature, you acknowledge and agree to the following:

Third-Party Service Dependency

Sticker packs are stored on Telegram's servers, NOT on ImageSticker.pro. We have no control over Telegram's availability, performance, policies, or data retention practices.

Bot Ownership Model

Sticker packs are created by @ImageStickerProBot (owned by ImageSticker.pro) but associated with your Telegram account. This dual-ownership model means:

⚠️ Public/Global Nature

ALL TELEGRAM STICKER PACKS ARE PUBLICLY VISIBLE to all Telegram users worldwide. Anyone who knows or discovers the pack URL can:

  • View all stickers in the pack
  • Install the pack for their own use
  • Share the pack URL with others
  • See your Telegram username/display name as the pack owner

There is NO private or unlisted mode for Telegram sticker packs. All packs are globally accessible.

3.1 Pricing

All prices are listed in USD and processed through our payment provider LemonSqueezy. Prices are subject to change without notice.

3.2 Payment Processing

Payments are processed by LemonSqueezy, a third-party payment processor. By making a purchase, you agree to LemonSqueezy's terms and privacy policy. We do not store your payment card information.

3.3 Taxes

Prices do not include applicable sales tax, VAT, or other local taxes. Taxes will be calculated and added at checkout based on your billing address.

4. AI Service Limitations

4.1 Third-Party Dependency

IMPORTANT: This Service relies on Google Gemini API, a third-party artificial intelligence service operated by Google LLC. We have no control over the availability, performance, or rate limits of the Gemini API.

4.2 Rate Limiting

Google imposes rate limits on API usage that are beyond our control. During high-demand periods, you may experience:

We implement automatic retry logic and model fallback mechanisms to minimize disruptions, but cannot guarantee uninterrupted service.

4.3 Content Restrictions

Google's AI safety filters may block or refuse to generate content deemed inappropriate, violent, or otherwise violating Google's usage policies. Such blocks result in generation failure and automatic credit refund.

5. Refund & Dispute Resolution Policy

5.1 Limited Remedies

Your sole and exclusive remedies for any complaint, dispute, or service issue are limited to ONE of the following two options:

  1. Service Credit Refund: We may issue credits to your account for future sticker generation (same tier as original purchase). Service credits do NOT extend your expiration date.
  2. Monetary Refund: We may refund the amount paid for the specific transaction in question to your original payment method within 14 business days.

  2. Include your order ID, Firebase UID, and detailed description of the issue

Any disputes not resolved through our refund process shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to a jury trial or class action lawsuit.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

WE ARE NOT RESPONSIBLE FOR THE PERFORMANCE, AVAILABILITY, OR POLICIES OF THIRD-PARTY SERVICES INCLUDING GOOGLE GEMINI API, FIREBASE AUTHENTICATION, LEMONSQUEEZY PAYMENT PROCESSING, OR TELEGRAM MESSENGER (for sticker pack creation and hosting). YOUR USE OF THESE SERVICES IS GOVERNED BY THEIR RESPECTIVE TERMS.

7. Limitation of Liability

7.1 Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 30 DAYS PRECEDING THE CLAIM.

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

You are responsible for maintaining the security of your Firebase Authentication credentials and any linked Telegram accounts. We are not liable for unauthorized access to your account or sticker packs created via your Telegram account.

NSFW CONTENT IS STRICTLY PROHIBITED.

You may NOT use this Service to generate, attempt to generate, or upload source images containing Not Safe For Work (NSFW) content, including but not limited to:

  • Sexually explicit or suggestive content
  • Nudity or partial nudity
  • Violence, gore, or graphic injury
  • Hate speech, harassment, or discriminatory content
  • Illegal activities or regulated goods (weapons, drugs, etc.)
  • Content depicting or exploiting minors in any way
  • Any content that violates applicable laws or regulations

Automated Enforcement via Google Gemini Safety Filters

All generation requests are automatically screened by Google Gemini API's built-in safety filters. These AI-powered filters are operated and enforced by Google LLC, not by ImageSticker.pro.

Google's safety filters automatically block content deemed inappropriate, including NSFW, violent, hateful, or otherwise policy-violating material. When content is blocked:

Refund Policy for Safety Blocks: While we refund credits for safety blocks as a courtesy, this does not indicate acceptance or tolerance of policy violations. Our zero tolerance policy remains in effect, and we monitor all safety block events. Users with repeated violations will have their accounts suspended or terminated regardless of refunds issued.

Account Termination & Enforcement

We actively monitor safety filter blocks and user activity. We reserve the right to:

All generation attempts are logged with your Firebase Authentication user ID, timestamp, and safety filter results. This audit trail enables enforcement and investigation of policy violations.

Reporting Violations

If you encounter content that violates this policy or believe an account is being used inappropriately, report it to: abuse@imagesticker.pro

Zero Tolerance: We have zero tolerance for NSFW content. First violation may result in immediate account termination without warning. No refunds will be issued for credits associated with terminated accounts.

8.4 Telegram Sticker Pack Responsibility

When using Telegram bot integration features, you acknowledge and agree to the following:

Public Visibility & Global Distribution

  • Public Visibility: All sticker packs are publicly accessible to anyone who knows or discovers the pack URL
  • Global Distribution: Packs can be viewed, installed, and shared by all Telegram users worldwide
  • Your Telegram Name Visible: Your Telegram username/display name will be visible as the pack owner

Data Transfer & Storage

  • Data Leaves Our Site: Sticker images are transmitted to and stored on Telegram's servers
  • Permanent Storage: Telegram stores packs indefinitely; deletion requests processed via ImageSticker.pro (pack editor) or @Stickers (Telegram Bot)
  • Telegram's Policies Apply: Content uploaded to Telegram must comply with Telegram's Terms of Service and content policies

Bot Ownership & Management

  • No Transfer Capability: Packs created by @ImageStickerProBot cannot be transferred to other bots or accounts
  • Bot Association Permanent: Packs remain linked to @ImageStickerProBot even after unlinking your Telegram account
  • Unlinking Consequences: Unlinking Telegram account removes pack editing capability from ImageSticker.pro (use @Stickers bot instead)

Important: By creating a Telegram sticker pack through ImageSticker.pro, you consent to the public nature of the content, data transfer to Telegram's servers, and Telegram's terms and policies governing sticker pack content and distribution.

9. Intellectual Property

9.1 Generated Content Ownership

You retain ownership of images you upload. Generated stickers are provided for your personal use. We make no claims to intellectual property rights in generated content.

9.2 AI-Generated Content Limitations

AI-generated content may not be eligible for copyright protection under current laws. We make no representations regarding the copyrightability of generated stickers.

9.3 Trademarks and Third-Party References

Certain art style names reference well-known animation styles, brands, or artistic aesthetics (e.g., "Disney," "Pixar," "Funko Pop," "Nintendo," "Simpsons," "Family Guy," "South Park"). These references:

The use of these names is intended solely to describe generalized artistic styles and does not suggest any connection with the trademark owners.

Style Accuracy Disclaimer: AI-generated results using these style names are approximate interpretations and may vary in their resemblance to the referenced styles. We make no guarantees that generated content will precisely match any specific artistic style, brand aesthetic, or user expectations.

Generated content is created by AI based on style descriptions and does not reproduce, copy, or infringe upon copyrighted characters or works. Users are responsible for ensuring their use of generated content complies with applicable intellectual property laws.

  • Any form of fraud, manipulation, or abuse of the referral system

Consequence: Any form of fraud or abuse will result in immediate account termination and forfeiture of all credits.

10.5 Referral Code Duration

10.6 Changes to Program

We reserve the right to modify or terminate the referral program at any time. Changes will be communicated via email or in-app notification. Existing earned credits will not be revoked due to program changes.

11. Termination

We reserve the right to suspend or terminate your account for violations of these Terms, including abuse of the refund process, fraudulent activity, or excessive API abuse. Termination does not entitle you to a refund of unused credits.

12. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms are governed by the laws of the State of Arkansas, United States, without regard to conflict of law principles. Both parties agree to submit to the exclusive jurisdiction of the state and federal courts located in Arkansas for resolution of any disputes.
